This website and store are operated by Octopied Mind Inc. (“Octopied Mind,” "OM", “we,” “us,” “our”). By visiting our site or purchasing from us, you agree to these Terms of Service ("Terms") and all policies published on our website, including our Shipping Policy and Refund Policy. Please read them carefully.

1) Using Our Site

You must be the age of majority where you live to use the site and make purchases. Don’t use the site for anything illegal or that could harm the site or other people. We can refuse service to anyone, anytime.

2) Orders, Pricing, Currency and Availability

  • We may limit or cancel orders at our discretion (for example: suspected resellers, duplicate accounts, mismatched details, or fraud screening flags).

  • We use Shopify Fraud Protect and internal checks. If an order risk is medium, we may manually approve. If high, we cancel.

  • Prices, product info, availability, and promotions can change without notice. Errors can happen; we can correct them and cancel/refund orders placed on incorrect information.

  • You agree to provide accurate, current billing, shipping, and contact details.

  • All prices are shown in Canadian dollars (CAD), which is our store’s core currency. For customers outside Canada, prices may be adjusted by a small percentage to account for currency differences and exchange rates. Gift cards are issued in CAD, and while we adjust pricing for USD shoppers to reflect an approximate conversion, the redeemable value may vary slightly due to exchange differences.

3) Products & Colors

We do our best to show products accurately, but displays and settings vary. We don’t guarantee your screen’s color accuracy or that every description is error-free.

4) Returns & Refunds

All returns, refunds, and timing are governed by our Refund Policy. Please review it before buying.

Final Sale Items

Items marked Final Sale (including “Surprise/Mystery Bags,” “Defected,” “Samples,” and gift cards/e-gift cards) are non-returnable and non-refundable.

Discounts & Promotions

Discounts are not applied retroactively. Promotions are time-bound and may change or end without notice. Some exclusions may apply.

5) Accounts & Communication

You’re responsible for keeping your account secure and for all activity under it. We may contact you about your orders, account, or service updates even if you’ve opted out of marketing.

6) Reviews & User Content

If you submit reviews/photos/comments (e.g., via Loox), you grant us a non-exclusive, worldwide license to use, display, edit, and share that content in connection with our business. Don’t post anything unlawful, infringing, or harmful. We can moderate or remove content at our discretion.

7) Intellectual Property

All site content (artwork, graphics, product designs, text, photos) is owned by or licensed to Octopied Mind and protected by IP laws. Don’t copy, distribute, or use our content without written permission.

8) Third-Party Services & Links

We run our store on Shopify and use third-party tools and partners (examples include payment gateways like Klarna, accounting via QuickBooks, customer support via Gorgias, returns via Loop, warehousing/fulfillment via 3PL, analytics/ads via Meta, TikTok, Google, Klaviyo). Their services may have their own terms and privacy rules. We’re not responsible for third-party sites or how they operate.

By completing checkout, you acknowledge and agree to the policies, terms, and conditions of any third-party shipping carriers used to fulfill your order, including but not limited to those related to delivery timelines, delays, customs processing, duties, tariffs, and import fees.

9) Prohibited Uses

Don’t:

  • Break any laws or infringe IP rights

  • Post or transmit malware, spam, or harmful code

  • Scrape, crawl, or attempt to bypass security

  • Harass, threaten, or abuse others
    We can suspend or terminate access for violations.

10) Mobile (SMS) Terms – Summary

If you opt in to SMS, you agree to receive recurring texts about orders, support, and marketing. Message/data rates may apply; frequency varies. You can opt out anytime by replying STOP (or using the unsubscribe link where available). For help, reply HELP or email support@octopiedmind.com. SMS is optional and not a condition of purchase. See our full Messaging Terms if provided separately.

11) Warranties & Disclaimer

The site and all products/services are provided “as is” and “as available.” We don’t promise uninterrupted, timely, or error-free service, or that every defect will be corrected.

12) Limitation of Liability

To the maximum extent allowed by law, we’re not liable for indirect, incidental, special, or consequential damages (including lost profits, lost data, replacement costs). Our total liability for any claim won’t exceed the amount you paid us for the order related to that claim.

13) Indemnity

You agree to indemnify and hold Octopied Mind and our team harmless from claims, losses, and costs (including reasonable legal fees) arising from your misuse of the site, your breach of these Terms, or your violation of laws or third-party rights.

14) Termination

We may suspend or end your access to the site at any time for any reason. Obligations that by their nature should survive termination (e.g., IP, limitations of liability, indemnity) will survive.

15) Governing Law

These Terms are governed by the laws of Canada. Any disputes will be handled by courts with jurisdiction in Canada.

16) Changes to These Terms

We can update these Terms at any time. The latest version on this page applies. If you continue using the site after changes, you agree to the updated Terms.
